 2017-2018 Summer China Program Student Agreement

 

1.       Curriculum

a. Courses

Summer China Program (“SCP”) for Australia provides courses similar to those offered in post-secondary full-time summer curriculum in Australia. Each SCP course has 40 total class hours. The SCP admission requirements, reading materials, course syllabi, and methods for evaluation are designed by the relevant professors and are consistent with the standards of the majority of post-secondary institutions in Australia.

 

b. Lecturers

SCP faculty members are selected from a small group of well-qualified members of the academia. Each of the SCP faculty members holds a minimum degree of Doctor of Philosophy or equivalent degree in his/her field. SCP also requires that he also currently serves as an instructor at an accredited Australian post-secondary institution.

 

c. Course syllabi

Each SCP course syllabus is independently designed by the faculty member teaching the course. Each syllabus includes course description, required reading materials, and methods for evaluation.

 

2. Eligibility

a. Each prospective student (“Applicant”) must first register for an online account on the SCP website and complete the SCP Online Application to be considered for the admission of SCP program. Upon receiving the Official Letter of Admission from the SCP Admission Office, the Applicant must make the payments specified in Section 10.1 before December 2nd, 2015 to become an SCP student (“Student” or Applicant, together with SCP “Parties,” or singly “a Party”). A Student can select courses from the Student Management System after his/her payment.

 

b. SCP is not responsible for an Applicant’s losses or liabilities whether contractual, tortious, or criminal made in reliance of becoming a Student at the SCP program.

 

c. The online account and application are found at www.scpaustralia.org.

 

d. If part of the Online Application is deemed fraudulent, the Student may be summarily dismissed from the SCP program or deregistered from the relevant courses without any refund. In addition, Beijing Yi Xue Hua Teng Education & Technology Co., Ltd and eXue Education Group, LTD reserve the right to costs incurred as the result of from the fraudulent information from him/her.

 

3. Transcript

a. Institution of transcript issued

All SCP transcripts are officially issued and stamped by the School of International Cultural Exchange of SISU.

 

b. Transcript format

The content of SCP transcripts include, but is not limited to, Student’s name, course completed, and course grades. Transcripts are written in both Chinese and English.

 

c. A copy of the transcript will be mailed to each Student’s mailing address within one month of the completion of SCP.

 

4. Student evaluation

a. Source of grades

All SCP course grades are determined independently by the professor or lecturer of each course, according to the methods outlined on the relevant syllabus, or announced by the professor or lecturer during SCP. Each professor reserves the right to provide explanation for grades he/she assigns. SCP will not intervene or influence Student evaluation in any way.

 

b. Percentage and letter grade conversion scale

SCP will use the following scale to convert between percentage and letter grades: 85 100=HD, 75-84=D, 65-74=CR, 50-64=P, 49 or below = F.

 

5. Overseas undergraduate Students credit transfer eligibility and limitation

a. Section 5 only applies to Students that are currently enrolled in full-time undergraduate program in an accredited college/university outside of the People’s Republic of China, including Students that are officially admitted to such institutions but has not begun studies.

 

The credits for each SCP course may be recognized differently by different Australian institutions, thus the completion of any of the SCP courses does not guarantee successful credit transferring.

 

To transfer credits from a SCP course, overseas undergraduate Students must complete the procedure outline below:

 

i.                     Prior to adding a SCP course in the application process, obtain full syllabus of the course from the official SCP website

ii.                   Contact the Study Abroad Office (or equivalent) in the home institution to obtain credit transfer application form and/or detailed instructions.

iii.                  Submit the syllabus and application form obtained from Study Abroad Office to the relevant Department or College in the home institution and follow its instructions for credit transfer pre-approval.

iv.                  Upon obtaining the SCP transcript, submit the transcript to the relevant Department or College in the home institution within the deadline specified by the institution.

 

b. If a Student cannot obtain proper credit transferring pre-approval from the home institution prior to committing to SCP, SCP cannot guarantee, and is not responsible for the successful transferring of credits.

 

6. SCP credit usages for domestic undergraduate Students

6.1 Section 6 only applies to Students who are currently enrolled in a full-time undergraduate program in an accredited university within the People’s Republic of China, including Students that are officially admitted to such a university but has not begun studies.

 

6.2 The majority domestic (Chinese) universities do not accept academic credits from an overseas curriculum; therefore it may not be possible to transfer SCP credits to domestic universities.

 

6.3 Domestic Students are also eligible for SCP. However SCP cannot guarantee, and is not responsible for the successful transferring of credits.

 

7. SCP credit usage for prospective overseas Students

7.1 Section 7 applies to domestic high school Students or high school graduates who plan to apply for undergraduate programs outside of China in the future, and have not been admitted to such programs.

 

7.2 Prospective overseas Students are eligible for SCP. However SCP cannot guarantee, and is not responsible for the successful transferring of credits once these Students are admitted into an overseas undergraduate program.

 

7.3 For a prospective overseas Student, SCP transcript is an ideal indicator of the Student’s academic achievement and language skills. Since SCP courses mirror relevant courses in Australia, and are taught by lecturers with current full-time professorship positions in Australia, the grades on SCP transcripts holds much higher credibility comparing to grades on transcripts from a domestic high school or undergraduate program.

 

8. Other usages of SCP credits

For Students whose academic background is not included in Sections 6, 7 and 8, SCP cannot guarantee, and is not responsible for the successful transferring of credits.

 

9. Policy for adding/dropping courses

9.1 Prior to November 29, 2017, SCP courses can only be added and dropped online. Each Student must log into his/her SCP web account to add/dropped courses. Starting on  November 30, 2017, courses can only be added and dropped with the SCP registrar on the each of SCP’s campuses.

Beijing Campus---Course changes may not be made between December 20th, 2017 and January 12th, 2018. The last day to add a course is December 19th, 2017; the last day to drop a course without showing on transcript is December 19th, 2017; and the last day to withdraw from a course is July 27th, 2017.

Shanghai Campus---Course changes may not be made between January 17th, 2018 and February 8th, 2018. The last day to add a course is January 16th, 2018; the last day to drop a course without showing on transcript is January 16th, 2018; and the last day to withdraw from a course is February 1st, 2018.

 

9.2 Each SCP course has a maximum capacity, determined by the relevant professor. Once the maximum capacity is reached, the course is unavailable to add Students.

 

9.3 If a SCP course must be cancelled due to unforeseeable reasons, affected Students can select another course. If a Student forced to select a course in this way, he/she is not limited by Section 9.2.

 

10. Policy for payment and refund

10.1 SCP mandatory fees include Tuition: 23,723 RMB (1 Course) or 27,323 RMB (2 courses).

 

10.2 Course registration can only be activated after each Student has paid all mandatory fees in full.

 

10.3 Each Student may take 1-2 SCP courses.

 

10.4 The refund policy for mandatory and optional fees is outlined in the table below

10.5 Refund of mandatory fees is an automatic withdraw from SCP. No SCP course can be taken by anyone who has withdrawn from SCP.

 

12. Miscellaneous

12.1 In addition to SCP, each Student’s eligibility for SCP and SCP credit transferring may also be limited by his/her home institution and its academic departments. It is the Student’s responsibility to understand relevant policies of their home institutions.

 

12.2 If failure to transfer SCP credits to an institution, or the credits failed to contribute to a major, minor or distribution requirement, results from the policies of the Student’s home institutions, Beijing Yi Xue Hua Teng Education & Technology Co., Ltd  and eXue Education & Technology Group, LLC does not hold any responsibility.

 

13. Agency and partnership

SCP does not consent to an agency or partnership relationship with Student, or with any of its agents, representatives, instrumentalities, or contractors.

 

14. Force majeure

A party is not liable for failure to perform the party's obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.

 

15. Arbitration

Any dispute, difference or claim arising out of or in connection with this contract, shall be referred to and determined by arbitration in the People’s Republic of China.

 

16. Waiver of Jury Trial

PARTIES KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVE ANY RIGHT TO TRIAL BY JURY WHICH SCP, THE STUDENT, AND THE APPLICANT MAY HAVE IN ANY ACTION OR PROCEEDING, IN LAW OR IN EQUITY, IN CONNECTION WITH THIS AGREEMENT OR THE TRANSACTIONS RELATED TO THIS AGREEMENT. THE APPLICANT, OR THE STUDENT, REPRESENTS AND WARRANTS THAT NO REPRESENTATIVE OR AGENT OF SCP HAS REPRESENTED, EXPRESSLY OR OTHERWISE, THAT SCP WILL NOT IN CASE OF LITIGATION SEEK TO ENFORCE THIS JURY TRIAL WAIVER. THE APPLICANT, OR THE STUDENT, ACKNOWLEDGES THAT SCP HAS BEEN INDUCED TO ENTER INTO THIS AGREEMENT BY, AMONG OTHER THINGS, THIS SUBSECTION.

 

17. Governing Law, Jurisdiction, and Venue

All matters relating to the interpretation, construction and enforcement of this agreement shall be governed by the laws (excluding choice of law principles) of People’s Republic of China. Any dispute, controversy or claim arising out of or relating to this Agreement that is not subject to arbitration may be brought only in the courts of People’s Republic of China, and Parties consent to the personal jurisdiction of such courts over them and waive any objection to venue.

18. Non-waiver

The failure by a Party to require performance of any provision shall not affect that Party's right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Contract constitute a waiver of any subsequent breach or default or a waiver of the provision itself.

 

19. Savings clause

If any provision of this agreement is held unenforceable, then such provision will be modified to reflect the Parties' intention. All remaining provisions of this agreement shall remain in full force and effect.

 

20. Merger clause

This agreement and the exhibits attached hereto contain the entire agreement of the parties with respect to the subject matter of this agreement, and supersede all prior negotiations, agreements and understandings with respect thereto. This agreement may only be amended by a written document duly executed by all parties.

 

21. Review of Agreement

Applicant carefully considered the terms of this agreement and the documents executed in connection herewith and, after consulting with its attorney or having had the opportunity to do so and choosing not to do so on a fully informed basis, is satisfied that this agreement and the documents executed in connection herewith are fair and reasonable.
